Chapter I General Provisions

[编辑 | 编辑源代码]

Section 1

Nationality is the legal link between a citizen and the State and recognition of national status. This Act shall apply to the acquisition, loss, restoration and proof of nationality.

Section 2

The nationality system shall observe the principles of preventing statelessness, avoiding arbitrary deprivation of nationality, non-discrimination in nationality on grounds of marriage or sex, preserving the integrity of the State and safeguarding individual rights.

Chapter II Acquisition of Nationality

[编辑 | 编辑源代码]

Section 3

A child with at least one parent who is a citizen of Einsenland shall in principle be eligible to acquire Einsenland nationality.

Section 4

A natural person born within the territory of Einsenland, excluding the floating territory of another State, shall be eligible to acquire Einsenland nationality.

Section 5

A foreign national shall not automatically acquire the nationality of this State by reason of long-term residence, employment, marriage or other ordinary circumstances. Acquisition by naturalisation shall be a special permission granted by the State on considerations of the public interest, social stability and allegiance to the State, and shall not constitute a right automatically enjoyed by any person.

Section 6

The requirements for naturalisation shall be:

continuous lawful residence for at least 10 years;

absence from the country for no more than 90 days in each year;

total absence not exceeding 24 months;

passing an official-language test;

passing an assessment of national identification and civic knowledge;

sufficient capability, or a major contribution to this State.

The naturalisation procedure may be simplified in accordance with the law for persons who have made a major contribution to the State.

Chapter III Loss and Renunciation of Nationality

[编辑 | 编辑源代码]

Section 7

A national who voluntarily applies to renounce nationality shall lose it upon approval. A citizen who acquires the nationality or passport of another State shall register that fact with the relevant authorities, and their Einsenland nationality shall be cancelled in accordance with the law. Persons performing military service, involved in pending litigation or cases, or concerned with major State secrets shall not apply to renounce nationality.

Section 8

No person shall be arbitrarily deprived of nationality on grounds of origin, opinions, race, language, religion or lawful political activity.

Section 9

Where nationality was acquired by fraud, falsified documents or concealment of material facts, the decision granting nationality may be revoked through statutory procedures. Any children shall retain their status.

Chapter IV Dual Nationality and Restrictions

[编辑 | 编辑源代码]

Section 10

The Republic of Einsenland shall not recognise dual nationality under any circumstances.

Section 11

A person who obtains a foreign passport without declaring it and simultaneously holds passports of this State and another State shall be deemed automatically to have renounced their status in the Republic of Einsenland. Their Einsenland passport and status shall be cancelled, and they shall leave the country within a prescribed period. A person who refuses to leave shall be forcibly removed and shall not enter the country for 20 years.

[编辑 | 编辑源代码]
